Competition Terms & Conditions

General

These conditions apply to participation in competitions and tenders from CALIDA AG and/or the Facebook page (@CalidaSchweiz), TikTok page (@Calidaswitzerland) or Instagram page (@calidaswitzerland).

Participation

The organiser of the competition on the above Facebook, Instagram and TikTok pages is CALIDA AG, Industrie Münigen, CH 6210 Sursee, (hereinafter referred to as ‘CALIDA’). Any gender-specific pronouns used below shall refer to all genders. Participation in the competition is only possible if the conditions of participation relating to that specific competition are taken into account. You can find the relevant terms and conditions of participation in the information about the competition on our Facebook, Instagram or TikTok pages. The competition starts upon being published on the CALIDA Facebook, Instagram or TikTok page. Entry is only possible until the specified time of the draw. You can find the relevant times in the information about the competition on our Facebook, Instagram or TikTok page. The competition is not sponsored by Facebook, Instagram or TikTok and is in no way affiliated with Facebook, Instagram or TikTok.

Conditions for participation

The competition is free to enter and does not require a purchase or the use of any paid services. All residents of Switzerland and the European Union aged 18 and over, with the exception of CALIDA AG employees, are eligible to participate in the competition. Participants are only entitled to enter the competition once. Multiple entries are not permitted and will not be considered. CALIDA employees are excluded from participation in the competition. By participating in the competition, the participant acknowledges and agrees with the terms of participation. Any costs incurred by the participant as a result of participating in the competition that are outside of CALIDA’s control (e.g. personal online access by the participant) shall be borne solely by the participant.

Data protection

  • Accuracy of data

    Participants must ensure that all of their data is correct, complete and true. Note that intentionally false or misleading information in your entry could result in you being excluded from participating.

  • Data security

    CALIDA and its service providers offer no guarantee that electronically transmitted data will not be lost or seen by third parties, and it accepts no liability in this regard.

  • Data usage

    The personal data of winning participants will only be used by CALIDA within the context of the competition and will not be published or made available to third parties. By participating in this competition, the participant agrees that, should they win, they will be publicly announced as the winner by means of the publicly visible account information associated with their entry and that CALIDA may contact them directly via private channels. By participating in the competition, the participants agree that the comments they post, as well as their username, may be published online on CALIDA websites and/or CALIDA social media sites if they win.

Disqualification from the competition

CALIDA is authorised to disqualify individual participants from the competition if there is a justified reason for doing so, e.g. a violation of the terms of participation, an attempt to influence the competition, tampering, etc.

In addition, any participant who posts sexist, racist, religion-related or otherwise discriminatory comments will be immediately disqualified from the competition. CALIDA reserves the right to disqualify participants who have posted any sexist, racist, religion-related or otherwise discriminatory comments.

Draw of prizes and vouchers

By entering the competition, participants are automatically participating in a prize draw for a CALIDA product and they automatically accept the terms of participation specified here. The entry deadline will be indicated in the relevant competition post. Entries received after the deadline for the competition has passed will not be considered, irrespective of the reason for the delay. The electronic time stamp on the entry is decisive. CALIDA shall not be liable for late entries and, in particular, cannot be held responsible for technical problems during the transmission of the entry, particularly network, power and computer failures. CALIDA will inform the winner by posting a comment under the winner’s photo/comment and specifying/linking their account name via a public post on Facebook, Instagram and/or TikTok. The winner will also be informed of the next steps that they must take to initiate private communication/contact. Any further communication between CALIDA and the winner will be conducted via private, personal message.

Selecting the winner

The winning participant will be privately selected within 30 days of the competition ending. Entitlement to the prize will lapse without compensation if the winner does not respond to the notification that they have won within five days.

Prize distribution

The prize will only be distributed to the winner. The prize will only be distributed as a non-cash prize; the prize cannot be exchanged and its value cannot be paid out in cash. After the winner has responded, CALIDA will automatically send the prize to the address on file, upon which all risk relating to the non-cash prize will transfer to the winner. The winner shall be responsible for any taxes due for the prize.

Appeals / applicable law

There will be no correspondence regarding the competition. The judges’ decision is final. The winner shall not have an enforceable right to receive or exchange the prize or have its value paid out in cash. Swiss law shall apply exclusively.

Changes to the rules of participation and ending the competition

CALIDA reserves the right to change the competition rules or terms of participation, etc. at any time. Furthermore, CALIDA reserves the right to end or suspend the competition at any time. This applies in particular in the event of circumstances that would make the scheduled completion of the competition difficult or impossible.

Facebook, Instagram and TikTok liability disclaimer

CALIDA is the organiser of the competition and is responsible for carrying it out. Competitions on the CALIDA Facebook and Instagram pages are in no way affiliated with, sponsored, supported or organised by Meta. Competitions on the CALIDA TikTok page are in no way affiliated with, sponsored, supported or organised by Beijing Bytedance Technology. The participant hereby releases Meta and Beijing Bytedance Technology from all claims in connection with this competition.

 All information is provided exclusively by CALIDA and not by Meta or Beijing Bytedance Technology. Furthermore, the participant provides their information for this competition to CALIDA, not Meta or Beijing Bytedance Technology. All questions, comments or complaints relating to the competition should be sent to CALIDA as the organiser of the competition, not to Meta or Beijing Bytedance Technology.

CALIDA limitation of liability

To the extent permitted by law, CALIDA shall not accept any liability.

Severability clause

If one of the provisions of the terms of participation is or becomes invalid or unenforceable, the validity of the other provisions shall remain unaffected. An invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely corresponds to the purpose intended by CALIDA.

Place of jurisdiction / applicable law

In the event of a dispute, Swiss law shall apply exclusively. To the extent permitted by law, the organiser’s place of business is agreed as the place of jurisdiction. If the participant does not have a general place of jurisdiction in Switzerland or moves to another country after participation, the organiser’s place of business is also agreed as the place of jurisdiction.
